AVANT ART FESTIVAL 2026 RULES AND REGULATIONS

§ 1. General provisions

1. These Rules and Regulations set out the terms of participation in Avant Art Festival 2026, taking place from 3 September to 11 October 2026, hereinafter referred to as the “Festival”.
2. The Festival is organised by Avant Art, with its registered office at ul. Bolesławiecka 1/24a, 53-614 Wrocław, entered in the National Court Register under KRS number 0000309792, Tax Identification Number NIP 8971747450 and Statistical Number REGON 020856955, hereinafter referred to as the “Organiser”.
3. The Organiser may be contacted by email at info@avantart.pl or by post at its registered office address.
4. The Festival includes concerts, exhibitions, film screenings, performances, workshops, meetings and other events taking place at venues listed in the current programme available at www.avantart.pl.
5. These Rules and Regulations apply to all persons attending Festival events. Participants are also required to comply with the rules and regulations of the venues at which individual events take place.
6. The purchase of a ticket or festival pass, receipt of accreditation, or entry to a free event constitutes confirmation that the Participant has read and agrees to comply with these Rules and Regulations.

§ 2. Tickets, festival passes and wristbands

1. Tickets and festival passes are sold through platforms indicated by the Organiser and, subject to availability, directly before individual events.
2. A ticket or festival pass entitles one person to attend. If it is issued in a named form, it may only be used by the person identified on the ticket or pass.
3. The Organiser may require the Participant to present photographic identification in order to verify their identity, age or entitlement to use a named ticket, festival pass or accreditation.
4. A festival pass may need to be exchanged for a wristband. The wristband is assigned to one person, must be worn throughout its validity period and may not be transferred, removed or altered.
5. The Organiser accepts no responsibility for tickets or festival passes purchased outside the official sales channels.
6. It is prohibited to forge or copy tickets or festival passes, or to resell them for profit at a price higher than the original purchase price.
7. Failure to use a ticket or festival pass for reasons attributable to the Participant does not constitute grounds for a refund.
8. Where a ticket or festival pass is purchased for an event taking place on a specified date or during a specified period, the Participant is not entitled to the statutory 14-day right of withdrawal applicable to distance contracts.

§ 3. Admission to events and participation of minors

1. Admission to an event is granted to persons holding a valid ticket, festival pass, wristband, accreditation, invitation or other valid entitlement to attend.
2. Participants should arrive sufficiently in advance. The Organiser may refuse admission to a late Participant if their entry could disrupt the event. Late arrival does not constitute grounds for a refund of the ticket or festival pass price.
3. Persons under the age of 16 may attend an event only under the supervision of a parent, legal guardian or another adult authorised by the parent or legal guardian. That adult must supervise the minor throughout their attendance at the event.
4. For ticketed events, both the minor and the supervising adult must hold valid tickets, unless otherwise stated in the event description.
5. Persons aged 16 or 17 may attend an event without an accompanying adult, provided that they hold a valid ticket, photographic identification and the written consent of a parent or legal guardian.
6. The Organiser may request a document confirming the Participant’s age, the consent of a parent or legal guardian, or written authorisation to supervise a minor.
7. The Organiser may impose different age restrictions due to the nature of the event, its finishing time, safety requirements or the rules of the venue. Information about such restrictions will be provided in the event description or during the ticket sales process.

§ 4. Conduct and safety rules

1. Participants are required to comply with the instructions of the Organiser, event staff, security personnel and the rules of the venue.
2. The Organiser may refuse admission to, or remove from an event, any person who:
   1. does not hold a valid entitlement to enter;
   2. is visibly under the influence of alcohol, narcotics or other substances with a similar effect, where their condition may pose a risk or disrupt the event;
   3. behaves aggressively, violently or discriminatorily, or in a manner that threatens safety or disrupts the event;
   4. refuses to comply with a lawful instruction issued by event staff or refuses to undergo a justified security check;
   5. breaches these Rules and Regulations or the rules of the venue.
3. A person refused admission to or removed from an event for reasons attributable to that person is not entitled to a refund of the ticket or festival pass price.
4. It is prohibited to bring weapons, explosives, pyrotechnic, flammable or dangerous materials, narcotics, alcohol purchased outside the event venue, or any other items that may pose a safety risk.
5. Rules concerning the bringing of food, drinks, glass containers and luggage are also determined by the rules of the relevant venue. Necessary medicines, food required for health reasons and products intended for young children are exempt from these restrictions to the extent reasonably required.
6. Animals are not permitted, except for assistance dogs and in other cases approved by the Organiser and permitted under the venue rules.
7. Without the Organiser’s consent, it is prohibited to bring professional audio or video recording equipment, livestream an event, or record an entire performance or a substantial part of it.
8. Event staff may ask a Participant to show the contents of their bag to the extent necessary to confirm that no prohibited items are being brought onto the premises. Refusal may result in admission being denied.
9. Participants must not obstruct entrances, exits or evacuation routes and must immediately report any identified danger to event staff.

§ 5. Conditions of participation and accessibility

1. Events may involve high sound levels, strobe lighting, theatrical smoke, darkness and other intense audiovisual effects.
2. Persons particularly sensitive to such effects, and adults responsible for children, should take the nature of the event into account when deciding whether to attend. The Organiser recommends the use of hearing protection, particularly by children.
3. The Festival takes place at venues with varying levels of accessibility. Information about the accessibility of individual events is published on the Festival website. Requests for additional support may be submitted to info@avantart.pl.
4. The Organiser takes measures appropriate to the nature of each event in order to ensure the safety of Participants. Nothing in these Rules and Regulations excludes the Organiser’s liability arising under applicable law.

§ 6. Programme changes, cancellations and refunds

1. The current Festival programme is published at www.avantart.pl.
2. The Organiser may change the order of performances, the times of individual programme elements, the host or moderator, the line-up of a project, an artist or the event venue where justified by organisational, artistic or technical reasons, safety considerations or circumstances beyond the Organiser’s control.
3. A change in the order of performances, a minor time change, a change of host, project line-up or an individual programme element does not constitute grounds for a refund where the event retains its essential character.
4. A delay to the start of an event that ultimately takes place in full or to a substantial extent does not constitute grounds for a refund of the ticket or festival pass price.
5. A delay to, or change in the starting time of, a single event included in a festival pass does not constitute grounds for a refund of the full festival pass price, provided that the remaining programme has taken place or the festival pass has retained its essential character.
6. If a ticketed event is cancelled, the Participant is entitled to a refund of the ticket price.
7. If a cancellation or material change concerns a single event included in a festival pass, any refund may cover only a proportionate part of the festival pass price corresponding to that event. A full refund of the festival pass price may be due only where the entire programme, or a substantial part of it, has been cancelled, or where the festival pass has lost its essential character.
8. If the date, venue or starting time of an event is materially changed less than 48 hours before its originally scheduled start, the Participant may withdraw from attendance and request a refund of the ticket price or a proportionate part of the festival pass price, provided that the change objectively prevents or significantly hinders their attendance.
9. The right referred to in paragraph 8 also applies where a material change results from circumstances for which the Organiser is responsible, regardless of when the change was announced.
10. The Organiser may postpone, interrupt, shorten or cancel an event due to force majeure, a safety risk, a decision of public authorities, a technical failure, the illness or inability of an artist to attend, or other circumstances that the Organiser could not reasonably have foreseen or prevented despite exercising due care.
11. Circumstances beyond the Organiser’s control do not deprive the Participant of the right to a refund for a service that was ultimately not provided, to the extent required by applicable law.
12. Refunds are processed by the entity through which the purchase was made, in accordance with the procedures communicated by the Organiser or the ticketing operator.

§ 7. Photography, recording and image rights

1. The Organiser may photograph, film and otherwise record the Festival for documentation, information, reporting, archival, promotional and security purposes.
2. A Participant’s image may be recorded and used without separate consent in cases permitted by law, in particular where the person appears only as part of a wider image of the audience or the event.
3. The publication of an individual portrait or close-up of a Participant requires their consent, unless another lawful basis applies. In the case of a minor, the consent of a parent or legal guardian is required.
4. Consent for a minor to attend an event does not constitute consent to publish an individual image of that minor.
5. A Participant who does not wish to be photographed or filmed in an individual shot may inform the photographer or event staff. Requests concerning already published materials may be submitted to info@avantart.pl.

§ 8. Personal data and complaints

1. The controller of personal data processed in connection with the Festival is Avant Art. Contact regarding personal data matters: info@avantart.pl.
2. Personal data is processed for the purposes of ticket sales and verification, event organisation, communication with Participants, handling refunds and complaints, compliance with legal obligations, ensuring safety and establishing, pursuing or defending legal claims.
3. Detailed information regarding the processing of personal data is provided in the Organiser’s privacy policy and in the information supplied by ticketing operators.
4. Complaints may be submitted by email to info@avantart.pl or in writing to the Organiser’s registered office address. A complaint should include contact details, a description of the circumstances and, where it concerns a purchase, the order or ticket number.
5. The Organiser will consider the complaint within 14 calendar days of receiving it.
6. Use of the complaints procedure does not restrict the Participant’s right to pursue claims under applicable law.

§ 9. Final provisions

1. A Participant is liable for damage caused through their own fault in accordance with applicable law.
2. Participants are responsible for looking after their personal belongings. The Organiser is not liable for items that are lost, left unattended or stolen, unless such liability arises under applicable law.
3. Matters not regulated by these Rules and Regulations are governed by Polish law.
4. The Organiser may amend these Rules and Regulations for important legal, organisational or safety-related reasons. Such amendments will not prejudice rights already acquired by persons who purchased tickets or festival passes before the amendments were introduced.
5. The current version of these Rules and Regulations is available at www.avantart.pl and, where possible, at Festival venues.
6. These Rules and Regulations enter into force on the date of their publication on the Festival website.
